Adu-Boahene and wife challenge AG, EOCO over GH¢200m bail conditions

The High Court is set to rule on a bail application filed on behalf of Kwabena Adu-Boahene, the former Director-General of the National Signals Bureau (NSB), and his wife, Angela Adjei Boateng.

 

The couple remains in custody as their legal team challenges what they describe as “unjustifiably harsh” bail conditions imposed by prosecutors. The case names the Attorney-General and the Economic and Organised Crime Office (EOCO) as respondents.

 

Adu-Boahene’s lawyers argue that the bail amounts—GH¢120 million for him and GH¢80 million for his wife—are excessive and deliberately designed to extend their detention beyond constitutional limits. They claim the state is using these stringent conditions to sidestep the legal requirement that detainees must be presented before a court within 48 hours.

 

“The Respondents, with a clear motive to incarcerate the Applicants beyond the 48-hour period as spelt out by the Constitution, have imposed burdensome and unreasonable conditions on the Applicants as the precondition for their granting them bail,” the defense team stated.

 

In their application, the lawyers also accused the state of violating their clients’ fundamental rights.

 

“The justification of the bail is at the pleasure of the Respondents,” they argued, describing the move as a blatant infringement on their clients’ right to liberty. They further alleged that Adu-Boahene and his wife have been denied proper legal representation, which they claim obstructs due process.

 

The High Court’s decision on the bail request is expected to be a critical moment in the legal battle surrounding the case.
