NDC National Communication Officer Sammy Gyamfi, is asking the High Court to quash a ruling by a Lower Court, granting permit to the Police to seize his personal effects.
The Kaneshie District Court had ruled that police can seize items of the NDC Communication Officer to help in their investigations into an alleged incident of cybercrime leveled against the NDC official.
Counsel for the applicant, Godwin Edudzi Tamaklo, however, argues that the District Court lacks the jurisdiction and also erred in law, when it gave the ruling which sought to disregard the fundamental human rights and freedoms of the applicant as enshrined in Chapter 5 of the 1992 Constitution.
The Lawyer in a 27-point suit is also demanding the immediate transfer of the case from a District Court to a High Court.
The suit is also requesting for an order restraining and prohibiting the Ghana Police Service from accessing the personal items seized from the applicant.
Meanwhile, a meeting between the NDC officer and the Criminal Investigation Department has since been rescheduled to December 24, 2019.
