Special Prosecutor fears Labianca ruling could encourage suspects to seek immunity from investigations

Special Prosecutor Kissi Agyebeng expressed deep concerns over recent court rulings, particularly the nullification of a report in the Labianca case.

The High Court ruling implicated two individuals, Col Kwadwo Damoah and Joseph Adu Kyei, for allegedly providing favourable tax treatment to Labianca Company.

Agyebeng voiced his apprehension, stating, “The danger of this startling decision is again quite obvious. A judge has in the process granted two persons immunity from investigation and in effect immunity from prosecution. This decision opens up a calamitous deluge as every person under criminal investigation will be encouraged to take out suits to injunct investigation and prosecution bodies from investigating and prosecuting them.”

He warned that such a trend would erode the progress made in the fight against corruption.

“I do not intend to sound as though I’m predicting doom, but we are facing it, and this is it. With this development, it will not be long; a suspected murderer or armed robber will boldly walk to court with the unthinkable prayer that the court should injunct law enforcement agencies from investigating him.”

Agyebeng emphasized the importance of upholding institutions and strengthening them, calling for support from all arms of government, especially the judiciary, and the Ghanaian public.

He stressed, “The OSP must be supported in its work. Should the OSP fail, Ghana would utterly lose the fight against corruption – with its attendant erosion of our democracy.”
