Two elected Assemblymen in Suame have threatened a legal action against top officials at the Municipal Assembly.
Benjamin Atta Obeng Boama and Iddrisu Yahya accuse the officials, including Municipal Chief Executive Maxwell Ofosu Boakye of spending monies without recourse to the procedures for approval at the assembly.
At a news conference on Tuesday the Assemblymen described conduct of the officials as a violation of the Local Governance Act, Act 936.
“This attitude by the MCE is in variance to the Local Government law in Act 936 which stipulates that every action by the assembly should be done in strict adherence to established laws”, the two stated at the press conference.
The two assemblymen have since filed a statement of notice to the assembly and copied same to the MCE to respond to the issues or seek the intervention of the court.
“Our lawyers have written to the Assembly notifying the top officials of this illegality. If we don’t get any appropriate response we shall consider going to the court to seek redress”, they said.
But responding to the claims the MCE Maxwell Ofosu Boakye said the allegations by the two assemblymen were unfounded.
“No action of mine has been done outside the law establishing this office and as enshrined in the Local Government Act”, Ofosu Boakye stated.
“I was confirmed as MCE in October by which time budget for 2022 had been drawn by my predecessor and since it needed approval, the Finance and Administration sub committees met and suggested a review of the budget subsequently”, the MCE explained.
